Terms of Service

  1. By accessing or using Fitvanta Performance services, you agree to be bound by these Terms of Service.
  2. You must be at least 18 years old or have parental consent to use our services.
  3. You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  4. All content, including videos, graphics, and text, is the intellectual property of Fitvanta and may not be reproduced without permission.
  5. You may not use our services for any illegal or unauthorized purpose, including violating intellectual property laws.
  6. We reserve the right to modify or discontinue any part of our services without prior notice.
  7. Payments are processed through secure third-party gateways; you agree to provide accurate billing information.
  8. Subscription fees are non-refundable except as outlined in our Refund Policy.
  9. We are not liable for any injuries or health issues resulting from participation in our workouts; consult a physician before starting.
  10. You agree not to harass, abuse, or harm other users or instructors in live classes or community areas.
  11. Unauthorized access to our systems, data mining, or scraping is strictly prohibited.
  12. We may terminate or suspend your account immediately for violations of these terms without refund.
  13. Our services are provided "as is" without warranties of any kind, either express or implied.
  14. In no event shall Fitvanta be liable for any indirect, incidental, or consequential damages arising from your use.
  15. You agree to indemnify and hold Fitvanta harmless from any claims arising from your breach of these terms.
  16. These terms are governed by the laws of the State of Kentucky, without regard to conflict of law principles.
  17. Any disputes must be resolved through binding arbitration in Florence, Kentucky, rather than in court.
  18. Our failure to enforce any right or provision of these terms does not constitute a waiver.
  19. If any provision is found unenforceable, the remaining provisions remain in full force and effect.
  20. These terms constitute the entire agreement between you and Fitvanta regarding our services.
  21. We may update these terms; continued use after changes constitutes acceptance.
  22. You may not assign your rights under these terms without our prior written consent.
  23. All notices must be sent to the contact address provided below.
  24. Headings are for reference only and do not affect interpretation.
